PRIVACY POLICY

This privacy policy is provided to you by Observa, Inc. (referred to as “we”, “us” or “Observa”).

This policy describes what information we collect and how we use that information. If you have questions about this privacy policy, please email as us at support@observanow.com.  When we refer to “Contact Information” we mean information like your name, address, telephone number and e-mail address. “Personal Nonpublic Information” refers to personally identifiable information about you and transactions in your Observa account, including information about your transactions.

What information does Observa collect?

In order to establish and service your Observa Account, we will initially ask you to provide only an email address. We will collect information about you from the Observa mobile application (the “App”), your transactions with us, correspondence and other communications between you and Observa. We may also collect and record information about usage of the Website and App in order to better serve our users and enhance our products and services.

How does Observa use this information?

We may use your Contact Information and Personal Nonpublic Information to service your Observa Account, to communicate with you, to obtain your opinions on our services, to send communications regarding our products and services to Website visitors, and to alert you to new products and services. We may also use Contact Information from time to time to tell you about other promotional opportunities.

Will Observa share my information?

Observa does not rent or sell information about its customers and we will only share your information under limited circumstances and always under strict controls against further disclosure. We will share your Contact Information and Personal Nonpublic Information with affiliated and unaffiliated third parties that perform services for us or for you, for example, third parties engaged in managing your Observa Account, completing money transfers and other transactions, vendors who assist us in offering related services, and others who assist us in sending communications to you. We require these third parties to keep your information confidential and we prohibit them from using your information for their own purposes.

We may invite you to participate in promotions and special offers offered directly by Observa or through specially selected third parties. Promotion materials will describe whether your participation in a promotion or offer will require us to gather and share your personal information with the sponsor or whether you will be asked to provide additional personal information directly to the sponsor. Participation in such programs is voluntary and such third parties are bound to maintain the confidentiality of, and not misuse, any personal information received from your or us.

In addition to the above, we may disclose Contact Information and Personal Nonpublic Information to unaffiliated third parties when one of the following circumstances exists:

  1. Where necessary for security purposes, to protect against fraud or unauthorized transactions, to resolve customer disputes or inquiries, or to respond to requests from persons who are acting in a fiduciary or representative capacity for you, or who hold a legal or beneficial interest in your account;
  2. To perform necessary credit checks or collect or report on debts owed to us; or
  3. As permitted by applicable law, including in response to legal process or requests from government authorities.

Finally, in the event Observa or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.

If you close your account with us, we will retain information about you and your account in an “inactive” status and we will continue to manage your Contact Information and Personal Nonpublic information as described herein.

How does Observa use cookies?

“Cookies” are elements of data that a website can send to your browser and store on your computer. Our cookies do not collect or contain personal information about you or compromise the confidentiality of your personal information.

Our system may automatically gather information about the areas you visit on our Website and about the links you may select from within our site to other areas of the Internet or elsewhere online. We could use such information in the aggregate to understand how our users as a group use the services and resources provided on our sites. We may link such usage information to Contact Information or Personal Nonpublic Information in order to securely verify your identity, to personalize aspects of your experience on our Website, to better understand which information or services are of greater value to our customers and users, and to send follow-up communications regarding our products and services to website visitors. The Observa website uses cookies, tracking pixels and related technologies. Cookies may also be used to track how you use the site to target ads to you on other websites.

You can choose whether to accept cookies by changing the settings of your browser. You can reset your browser to refuse all cookies, or allow your browser to show you when a cookie is being sent. You can also erase cookies already stored on your computer. If you choose not to accept these cookies or if you erase them, your experience on our Website and other web sites may be diminished and some features may not work as intended.

What are my opt out rights?

Because Observa does not share your information with affiliated or unaffiliated third parties for any purposes except as described above, such as helping us service your Observa Account and provide other services to Observa, you may not opt out of such sharing.

Security.

Observa takes the security of information very seriously and has established physical and electronic security standards and procedures to prevent unauthorized access to customer information. We use industry standard means such as physical, electronic and procedural safeguards, including data encryption and secure socket layer technology. We update and test our technology regularly to maintain and improve the protection of our customers’ information. We restrict access to personal information to employees and service providers for legitimate business purposes to assist in providing services to you. Employees who violate our privacy policy are subject to disciplinary action.
